By using hosting service provided by Catdynamics Hosting, you accept and agree to the following terms and conditions.
1. Catdynamics Hosting reserves the right, at its discretion, to modify these terms at any time. Your continued use of Catdynamics Hosting following the posting of any changes of these terms will mean you accept those changes.
2. Catdynamics Hosting reserves the right to remove any content, file, application, web page or complete website from its servers that it determines is in violation of its terms and guidelines and if necessary terminate the users account. Users and businesses are solely responsible for all files and applications contained on their hosting accounts and can be held legally liable for the contents.
The following is a list of content and behavior that is not acceptable on web pages hosted by Catdynamics Hosting:
a. Content, files and applications that cause excessive strain on our servers. In the case that a file or application is causing strain on our servers we will where appropriate contact you first so that action can be taken by your self to remedy the problem.
Where the strain is considered to high the file or application or website in question will be removed from our servers.
b. Content that promotes or contains links to sites containing nudity, pornography, adult material, sex, exploitation of children, etc.
c. Content that infringes on copyright, trademark, patent, trade secret or other intellectual property. This includes serial numbers for software for the purpose of illegally registering or validating software, unlawful MP3 music files, copyrighted images or videos, etc.
You may not use Catdynamics Hosting services or servers in any manner which infringes the intellectual property rights or other proprietary rights of any third party including, without limitation, material protected by copyright, trademark, patent, trade secret, or other intellectual property right used without proper authorization.
d. Content that condones, promotes, contains, or links to unlawful products or activities, including stolen goods, fraudulent goods, services, schemes, or promotions or provide false information signup forms, contract or online application or registration.
e. Content that promotes the sending of unsolicited e-mail (spam), or mail fraud schemes. Users and business who utilize Catdynamics Hosting services, including e-mail addresses for spam are also subject to prosecution to the fullest extent of the law.
f. Content or material that is racist or extremely offensive to others, including content which threatens or abuses others.
Loss or Corruption of Data
You acknowledge and agree that Catdynamics Hosting is not and shall not be responsible or liable for any loss or corruption of data that you may experience while using our hosting services nor are we required to return to you any data that you have stored on our hosting services.
This includes, without limitation, the loss or corruption of data resulting from the suspension, deletion, or modification of your content, files, applications, webs pages and complete web sites or in the event the Catdynamics Hosting site, network, system, or server “crashes”, is interrupted by outages, power outages, damaged by viruses, worms, security breaches, file corruption or any other cause.
We recommend that you to maintain backup versions of your web pages and related information to help protect yourself against such losses.
Payment
You agree to pay for the services on time, unpaid invoices will result in temporal suspension of your account.
Invoices are generated 7 days before the renewal date and your account gets suspended 7 days after the renewal date if the invoice is not paid within that time.
Your account will be terminated if it was not paid within 7 days after it was suspended. If you want us to restore it after it was terminated because of non-payment, and we have a backup of the terminated account you will have to pay $100 one-time fee plus all the renewal fees. We do not guarantee we will have a backup of your account after it was terminated!
Prohibited Content
Customers cannot host the following content on our servers:
- Anything related to IRC
- Anything related to torrents
- Warez, hacking tools, exploits
- Porn web sites
- Anything related to proxies
Transfers
We do free transfers of accounts you want moved to our servers from providers which use cPanel. We do not guarantee the quality of such transfers and you must verify if your account was moved correctly before you change the nameservers.
If something is wrong with the account after the move and it wasn’t moved correctly it is your responsibility to fix it. In 99% of the transfers there are no problems but we do not guarantee that. We do transfers just because of courtesy to our clients.
Staff Communication
Customers may communicate with our staff in polite manner. If you are rude with us, we will give you 72 hours to find another hosting provider. After 72 hours pass, we will permanently suspend your account and you will receive a refund for the unused portion of the service.
Limits
Customers may not send more than 200 e-mail messages per hour. Any account on the server cannot use more than 2% CPU or memory resources. If you use too many system resources, you will be notified to take the necessary actions.. If the usage is too high to keep the server unstable, we will suspend the overloading account so that it doesn’t affect the other clients on the server.
Term/Termination
A. Term – This agreement shall be effective upon applying for and taking up services offered by Catdynamics Hosting.
B. You may terminate this Agreement immediately for any reason at any time by contacting us at the hosting heldesk.
C. Termination by Catdynamics Hosting.
